State Supreme Court Rules Against Dems On RTW Fines
Tuesday, June 18th, 2013
(INDIANAPOLIS) - Indiana’s Supreme Court refuses to enter the realm of legislative
discipline. In a split decision the justices claimed the courts do not
have authority to strike down the fines that legislative leaders imposed on
Indiana Democrat House members who left the state last year to avoid a quorum on
a controversial Right to Work bill. In reversing the trial court’s
decision to strike down the fines, the justices said the issuance and collection
of fines as legislative discipline are functions constitutionally committed to
the legislative branch without express limitation or qualification by the
state’s Constitution. Three justices agreed with the decision, while one
dissented and another agreed in part and dissented in

Court Of Appeals Holds Hearing At TU On Boating Fatal
Tuesday, June 18th, 2013
(ANGOLA) - The Indiana Court of Appeals heard arguments on Tuesday before delegates attending Hoosier Boys State at Trine University concerning a 2010 boating accident in Monroe County which killed a woman and her grandson. Winston K. Wood is appealing his convictions from just over a year ago on a Class D felony of leaving the scene of a boating accident resulting in serious bodily injury to a person and on two Class C felonies for leaving the scene of a boating accident resulting in death. Wood got a nominal six-year sentence. He was 19-years-old at the time his speedboat collided with a fishing boat on Lake Monroe which killed 51-year-old Susan Collier and her eight-year-old grandson Gage Pruett. Collier's husband was injured in the accident. In his appeal, Wood is questioning whether the state presented sufficient evidence that he failed to comply with the duties required of a boater in an accident. He has also questioned whether Indiana law pertaining to a boaters duties during an accident is unconstitutionally vague and whether his convictions and sentence violate the principles of double jeopardy. Judges John G. Baker, James S. Kirsch and Melissa S. May heard the oral arguments. Another Court of Appeals case will be presented during Hoosier Girls State at Trine on June 27th. Delegates at that time will hear arguments in a Marion County probation-revocation case. The two Angola hearings are part of the "Appeals on Wheels" program that started almost a dozen years ago which allows Indiana citizens to see how the court works.

LaGrange County On The Hook For $10K In Failed Project
Tuesday, June 18th, 2013
(LAGRANGE) - Instead of a shell building with the prospect of higher paying jobs at the Fawn River Industrial Park, LaGrange County is left holding a bill. The LaGrange County Council and Commissioners approved a letter of intent to partner with Garmong Construction Services of Terre Haute last November to build the high tech shell building. But last month negative votes by three council members killed the project. That’s put the county on the hook for a $10,000 reimbursement to Garmong according to County Attorney Kurt Bachman. "We've been presented with an invoice from Garmong Construction Services, and this would be reimbursement of development costs. This would be in accordance with the letter of agreement that the county commissioners and the county council and redevelopment commission executed in November of 2012. The cost that they have invoiced the county for is $10,000. That needs to obviously go before county council at some point to consider for appropriation, because I don't believe we have the money appropriated for this." The commissioners on Monday sent the bill on to the county council with a recommendation to pay the reimbursement.

City Council Reverse Decision, Votes To Pay V-3
Monday, June 17th, 2013
(ANGOLA) - The Angola City Council reversed a decision they made two weeks ago on Monday night and decided on a 3-2 vote to pay a bill submitted by V3 Companies for nearly $11,000 in additional funds for work on the downtown Streetscape project. Council member Mike McClelland changed his vote from June 3rd and motioned for the bill to be paid. Council members were hesitant to approve the request for construction engineering services because it came in nearly two years after the extra work on the southeast side of the square was finished. Tom Valaitis from V-3 tried to assure Council members the bill was legitimate. He blamed the delay on slow paperwork processing by INDOT and the contractor but admitted his company could have been more efficient. In other business, A.P.I. Construction of Laotto submitted the low bid of over $154,000 for this years street maintenance projects. Three of the four bids submitted were below the budgeted cost of $176,000.

The Fremont School Board approved a request from Superintendent Laurie Vaughn on Monday night to reduce the number of positions by five-and-a-quarter. (ANGOLA) - In front of an overflow crowd of Lake George residents, Steuben County Commissioners denied a zoning change request on a 3-0 vote Monday morning from a potential buyer of the property which has been the site of the Lake George Marina. The Commissioners vote affirmed a decision made by the County Plan Commission on June 5th when they made a negative recommendation to the request. Dan Smith was looking to buy the property contingent upon it being rezoned from lake residential to general business so he would not have to make special exception requests. But many Lake George residents opposed the rezoning. Among their concerns were possible future businesses on land zoned general business. They also felt the rezoning request was not consistent with the County's Comprehensive Plan.

Lakers Gather On CAFO Application
Sunday, June 16th, 2013

At last report, IDEM has not taken any action on it and nothing has been submitted to the Steuben County Plan Office. Those opposed have 30 days from the time the application is filed to voice their concerns with the state. The application with IDEM was discussed briefly at the end of the Steuben County Plan Commission meeting a couple of weeks ago and it was mentioned at that time the applicant would have to seek a special exception from the county if the plans move forward. Interlocal Agreement Raises Concerns
Tuesday, June 4th, 2013
(LAGRANGE) - LaGrange County Commissioners have concerns about the language of an interlocal agreement between the county and Shipshewana covering a new development. Attorney Travis Glick outlined those concerns during this morning’s commission meeting. He said the proposed agreement doesn’t go far enough to limit the use of Major Moves funds to road construction for the Miller-King development. It included language regarding other infrastructure. Glick said the agreement also mentions no commitment on the part of the developer and it sets up a six member joint board that would oversee expenditures on the project. Commission President Jac Price felt such a commission was unnecessary. "It would be road construction that was invoiced to the town of Shipshewana. That invoicing would come to LaGrange County to be paid from the allocation and appropriation of $200,000 from the Major Moves, up to and not to exceed $200,000." Price said the developer has spent considerable funds on the project infrastructure. Commissioner Larry Miller said the commissioners and county council jointly approved the Major Moves expenditure for road construction only. Glick will offer changes to the agreement and report back to Shipshewana and the Commissioners.

Scrap Business Ordered To Clean Up Property
Wednesday, April 18th, 2012
(LAGRANGE) - LaGrange County Commissioners ordered a rural Shipshewana man on Monday to cease operating a scrap and salvage business and to clean up his property. The commissioners held a nuisance hearing concerning the property owned by Marlin and Mary Knepp at 7495 West County Road 100 North. County officials say the scrap and salvage business located just west of Shore Church has been the subject of complaints for years. Knepp said he's been so busy he's been unable to make much progress in cleaning it up but he promised changes. Code enforcement officer Jason Boggs asked commissioners to issue and injunction immediately. The commissioners granted the injunction and held off levying any fines for 30 days to give Knepp more time to clean up. They'll reconvene the hearing May 21st. County officials say Knepp needs a variance from the Board of Zoning Appeals to legally operate that type of business in an area zoned agriculture and may need to register his business with the state as well.
