State Supreme Court Rules Against Dems On RTW Fines
Tuesday, June 18th, 2013

(INDIANAPOLIS) - Indiana’s Supreme Court refuses to enter the realm of legislative discipline. In a split decision the justices claimed the courts do not have authority to strike down the fines that legislative leaders imposed on Indiana Democrat House members who left the state last year to avoid a quorum on a controversial Right to Work bill. In reversing the trial court’s decision to strike down the fines, the justices said the issuance and collection of fines as legislative discipline are functions constitutionally committed to the legislative branch without express limitation or qualification by the state’s Constitution. Three justices agreed with the decision, while one dissented and another agreed in part and dissented in part.

Court Of Appeals Holds Hearing At TU On Boating Fatal

Tuesday, June 18th, 2013

(ANGOLA) - The Indiana Court of Appeals heard arguments on Tuesday before delegates attending Hoosier Boys State at Trine University concerning a 2010 boating accident in Monroe County which killed a woman and her grandson. Winston K. Wood is appealing his convictions from just over a year ago on a Class D felony of leaving the scene of a boating accident resulting in serious bodily injury to a person and on two Class C felonies for leaving the scene of a boating accident resulting in death. Wood got a nominal six-year sentence. He was 19-years-old at the time his speedboat collided with a fishing boat on Lake Monroe which killed 51-year-old Susan Collier and her eight-year-old grandson Gage Pruett. Collier's husband was injured in the accident. In his appeal, Wood is questioning whether the state presented sufficient evidence that he failed to comply with the duties required of a boater in an accident. He has also questioned whether Indiana law pertaining to a boaters duties during an accident is unconstitutionally vague and whether his convictions and sentence violate the principles of double jeopardy. Judges John G. Baker, James S. Kirsch and Melissa S. May heard the oral arguments. Another Court of Appeals case will be presented during Hoosier Girls State at Trine on June 27th. Delegates at that time will hear arguments in a Marion County probation-revocation case. The two Angola hearings are part of the "Appeals on Wheels" program that started almost a dozen years ago which allows Indiana citizens to see how the court works.
